FIRSTS AFTER 40 2010/2011
COMPLETE RULES & REGULATIONS
1. The “Firsts after 40” Contest (the “Contest”) is sponsored by More Magazine – property of Transcontinental Media G.P. (“Transcontinental” or the “Sponsor”). The Contest starts at 12:01 am Eastern Daylight Savings Time (“EDT”) on August 10, 2010 and closes on January 21, 2011 at 11:59 p.m. (EDT) (the “Contest Period”). Any reference to time in this document indicates Eastern Daylight saving Time (EDT). Reader's choice voting will begin February 1, 2011 and end February 28, 2011.
ELIGIBILITY
2. The Contest is open to all female legal residents of Canada who are forty (40) years of age or older by the start date of this Contest as identified above. Employees, agents and/or representatives of Transcontinental the prize donors, their parent or affiliated companies, advertising and promotional agencies or any contributor to the Contest, as well as anyone with whom an employee, agent and/or representative is domiciled, or any member of his or her immediate family are not eligible to enter the Contest. For these official rules, “immediate family” refers to the father, mother, brothers, sisters, children, husband, wife or partner of such an employee, agent and/or representative.
HOW TO ENTER – NO PURCHASE NECESSARY:
3. Entries can be made in one of the following ways:
(i) Registration Online: To enter the Contest, log on to www.more.ca/firsts (the “Contest Website”) starting August 10th 2010 until January 21st, 2011. Submit your entry by completing the online entry form including a maximum 250 word essay on the topic of a ‘first’ after 40 dream (as described in section 14 below) and a photo of yourself in compliance with the “Photo Submission Guidelines” in sections 11 and 12 of these Contest Rules (the “Submission”).
OR
(i) By mail submit your original 250 word entry about on the topic of a ‘first” after 40 dream (as described in section 14 below) to:

4. Mailed Entries must be typed or clearly handwritten. Entries must be written in English. Illegible entries, bulk mailings, or reproductions are ineligible. Only one (1) Electronic Entry or Mail in entry per day per person for the duration of the Contest.
Each entrant can only use one e-mail address (which must be valid) to enter via the Electronic Entry form method. The same e-mail address cannot be used by more than one entrant.
5. All Entries must be received (or post marked in the case of mail in entries) by 11:59pm, January 21th, 2011. (EST).
- All Submissions will automatically become the exclusive property of the Sponsor, and none will be acknowledged or returned. The Sponsor shall have the right, but not the obligation, to edit, adapt and publish any or all of the Submissions, and may use them, at its sole option, in any media without compensation to the entrant, his/her successors or assigns, or any other entity.
- The Contest Sponsor will not be responsible for late, lost, destroyed, incomplete, illegible or wrongly addressed mail, or the failure or malfunction of any computer software, hardware or telecommunications equipment affecting participation in or any other aspect of this Contest.
- By participating in this Contest, entrant represents and warrants that: (i) the Submission does not contain any material that is libelous, defamatory, profane or obscene; (ii) the Submission is original material of the entrant and all right, title, and interest (including copyright) therein and thereto is owned and/or controlled by the entrant to the full extent necessary to enable the Contest Sponsor to use the Submission as contemplated by these Contest Rules; and (iii) the Submission does not infringe upon the intellectual property or other statutory or common law rights of any third party and has not been previously published.
- Furthermore, the entrant understands and agrees that:
- The Submission must not disparage the Sponsor, its agencies, prize donors, administrator or any party associated with the administration of this Contest;
- The Submission must not contain material that violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement;
- The Submission must not contain images or artwork not created by entrant and should not have been previously published;
- The Submission must not contain material that is inappropriate, indecent, obscene, hateful, torturous, defamatory, slanderous or libelous;
- Th e Submission must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; and
- The Submission must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any state or province where the Submission is created.
- Entering a Submission in this Contest constitutes entrant’s irrevocable assignment, conveyance and transfer to the Sponsor of any and all right, title and interest in the submission including, without limitation, all copyrights. All entries become the sole property of the Sponsor and none will be returned for any reason. Entries must be received no later than the end of the Contest Period. Entries will be declared invalid if they are late, illegible, incomplete, damaged, irregular, mutilated, forged, garbled or mechanically or electronically reproduced. No communication or correspondence will be exchanged with entrants except with those selected as prize winners
11.By submitting an entry or submission in respect of this Contest, all entrants automatically agree to the use of their photographs, names, images, likeness, biographical information and places of residence, without compensation, in print, radio, online or televised publicity relating to the Contest, and in particular, the pages of More Canada magazine, and automatically acknowledge that they waive the right for any payment, day fee or other monetary compensation from, in conjunction with or in any way relating to the Sponsor or the photo shoot for More Canada magazine. No negotiations with agents of any entrant will occur. All communications will take place directly between the Sponsor or its representatives or agents and the entrant.
Photo Submission Guidelines
- The photo submitted with your entry must be a photo of yourself, for which you have sole ownership, and must not include any other person, brand name, or recognizable logo or trademark.
- The photo cannot have been submitted previously in a promotion of any kind or exhibited or displayed publicly through any means.
- The photo must not exceed 1 MB in size and must be in any of the following formats: (i) .jpg; or (ii) .jpeg.
c Any photographs and/or video produced for, at or in connection with this Contest may be used for advertisements and/or promotional materials surrounding this Contest and may also be used by the Sponsor in their advertising, promotional, in-store, online and collateral sales and public relations materials.
THE JUDGING:
The winners will be selected by a panel of judges as set out in paragraph 14 below. Another winner will be selected by electronic public voting.
13. The decisions of the judging panel shall be final with respect to all aspects of the Contest. No correspondence will be entered into except with the entrants selected as finalists (and as the Grand Prize winner and finalists, as the case may be) and individuals requesting a copy of these Contest rules. The odds of an entrant being selected depend on the number and quality of eligible applications received by the Contest closing date. All applications will automatically become the property of the Contest Sponsor and none will be returned.
14. All Entries will be judged in the sole opinion of the Contest judges on: 1) The originality of the "First after 40" dream of an entrant; 2) the compelling nature of the entrant's story – why she wants to achieve this ‘first’, what makes her passion and commitment unique. The entry form should describe the entrant’s dreams, ambitions, desires, hopes and aspirations for her Firsts After 40 dream. The Sponsor is looking for a personal goal, not a goal related to business or career development. 15. Readers Choice
Online ‘Readers Choice’ winners: All entries received by the server hosting the Contest Website will be open for voting between February 1st, 2011 and February 28, 2011 (“the Voting Period”). Visitors to this site will be allowed to vote once per day for their favourite entry between these dates. Limit of one vote per entry per day per e-mail address during the Voting Period. After the Voting Period, the Reader’s Choice Prize winner will be based on the following criteria: number of votes received per valid entry.
During the Voting Period, the votes will be computed in a private log by Transcontinental. Transcontinental will disqualify, at its sole discretion and at any time during the Contest, any entry with suspicious or irregular vote data that may indicate cheating. Forms of cheating include, but are not limited to, creating invalid user accounts to vote for a Finalist photo or video and/or creating an automated script (also known as “bot”) to vote for a Finalist photo or video and/or any suspicious activity in a vote received for a Finalist photo or video.
The Reader’s Choice Winner will be announced on the Contest Website on March 1st, 2011 at 5:00 PM EST.
The decisions of the Judging Panel regarding the selection of the Winners are final and binding and not subject to appeal with respect to all aspects of the Contest. No correspondence will be entered into except with the Winners. Entrants selected as finalists will be notified by phone before February 7th, 2011. If a selected entrant does not reply to notification within 48 hours of February 7, 2011 or is not reached for any reason, including, but not limited to, the fact that a selected entrant has a call privacy feature on her telephone, or if any selected entrant does not meet all of the conditions of winning as set out in these Contest rules, she shall not be declared a finalist (or the winner or runner-up, as the case may be) of this Contest, and an alternate entrant shall be selected.
16. PRIZES:
16.1 Grand Prize. There will be one (1) Grand Prize awarded, consisting of:
- Five thousand dollars ($5,000) cash presented by Royal Bank of Canada;
- one Movado watch
- one Euphoria by Calvin Klein fragrance package(value $500.00)
- one NeoStrata Skincare basket (value $350.00)
- one Sears gift card (value $500.00)
- one Shiseido Make up collection (value $350.00)
vii. one White Wave Foods (SILK SOY) prize pack (value $500.00).

16.2 Secondary Prizes. There will be three (3) Secondary Prizes each consisting of:
- One thousand five hundred dollars ($1,500) cash presented by Royal Bank of Canada;
- one Movado watch
- one Euphoria by Calvin Klein fragrance package (value $350.00);
- one NeoStrata Skincare basket (value $250.00);
- one Sears gift card (value $250.00);
- one Shiseido Make up collection (value $250.00)
vii. one White Wave Foods (SILK SOY) prize pack (value $350.00).
- A photo shoot with More Canada magazine for special feature in a November 2011 issue of More magazine;

16.3 Readers Choice Prize. There will be one (1) readers Choice prize consisting of: $400 cash from More.ca/Transcontinental Digital Media.
17. The First Prize, Secondary Prizes and Readers Choice Prize are collectively referred to herein as the “Prizes”.
18. The Prizes must be accepted as awarded and are not transferable or convertible to cash. Should a Grand Prize Winner or a Secondary Prize Winner refuse a Prize, the prize sponsors: Royal Bank of Canada, Sears, COTY, Shiseido, Movado, NeoStrata (Canderm Pharma Inc.) and White Wave Foods (Silk Soy), (collectively, the “Prize Sponsors”) and their respective directors, officers, employees, agents, representatives, and advertising and promotional agencies are released from any obligation related to the Prize. The Prize Sponsors retain the right in their absolute discretion to make substitutions of equivalent kind or value in the event of the unavailability of any element of the prize for any reason whatsoever.
CONDITIONS OF WINNING:
19. An entrant’s mailed or online entry (including the photo required by these Contest rules) must be received by 11:59 p.m. (EDT) on the Contest closing date, January 21, 2011. To win a Prize, selected entrants must have complied with these Contest rules, must sign a standard declaration and release form confirming compliance with these Contest rules and acceptance of their Prize as awarded and releasing the Sponsors and Prize Sponsors, their respective directors, officers, employees, agents, representatives, and advertising and promotional agencies from any damage or loss that may result from entering this Contest or accepting and/or utilizing a Prize, and must sign a liability/publicity release form granting the Sponsors the right to use their name, city of residence, voice, biographical information, photograph, image and/or likeness without compensation for publicity or programming purposes, commercial or otherwise (except where prohibited), without payment or compensation, throughout the world in perpetuity. Selected entrants must return the completed forms within five (5) days of receipt. If the completed forms are not returned within the deadline, the selected applicant will be disqualified and another entrant will be selected until all Prizes have been awarded. The new selected entrant must return the completed forms within five (5) days of receipt.
As an additional condition of being declared a finalist (or the winner or runner-up, as the case may be), each selected entrant must first correctly answer, unaided, a time-limited skill-testing question which will be administered by the Sponsors or their agent at a mutually convenient time.
ADDITIONAL RULES TO NOTE:
20. INCOMPLETE OR LATE APPLICATIONS WILL NOT BE ACCEPTED. The Sponsor and their respective directors, officers, employees, agents, representatives and advertising and promotional agencies shall not be responsible for lost, stolen, delayed, damaged, destroyed, illegible, incomplete, postage due or misdirected entries, or for any failure or malfunction of any hardware, software or telecommunication component relating to online entries, or for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, or the failure of any e-mail or entry to be received by the Sponsor on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to an applicant’s or any other person’s computer related to or resulting from playing or downloading any material in or relating to this Contest or the promotion thereof.
21 Transcontinental reserves the right, in its sole discretion, to cancel, modify or suspend the Contest for any reason whatsoever, without individual notice, including, but not limited to, a virus, bug or other technical issue beyond the reasonable control of Transcontinental which corrupts the security or proper administration of the Contest. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, Transcontinental reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are illegible, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way.
22.The Sponsor and their respective directors, officers, employees, agents, representatives, sponsors and advertising and promotional agencies shall not be responsible for any inability to satisfy these Contest rules which arises from any situation which is outside of their control, including but not limited to a situation of strike, lock-out or other labour strife in the workplaces of any sponsor or in the workplaces of any organization or entity whose services are used for running this Contest. The Sponsors reserves the right to terminate, close or suspend, or alter the rules of, this Contest at any time, in their sole and absolute discretion, without prior notice, for any reason whatsoever. Applicants agree to abide by these Contest rules and the decisions of the independent judging panel, which are final.
PRIVACY AND USE OF INFORMATION:
23.The information collected by the Sponsor on the application forms will be used to administer the Contest, including to select potential winners and contact the selected entrants, in accordance with these Contest rules. By entering the Contest, entrants also consent to the use of their personal information submitted on their entry by the Sponsor for marketing and promotional purposes which may include, by way of example, contact by telephone, email and mail updates on special events and advance notice of new arrivals, promotions and store openings.
